Iulius Paulus

This volume, the sixth in the series dedicated to the figure of Iulius Paulus - an authoritative exponent, together with Aemilius Papinianus and Domitius Ulpianus, of Severan legal science - reconstructs the content of a work that we would be wrong, comparing it with the libri ad edictum, to consider minor: the commentary on the lex Iulia et Papia, a regulatory measure of the Augustan age. An examination of his texts, transmitted to us from the Justinian compilation, allows us to cast a glance at the jurist's methods and techniques that Pauline writing rarely offers elsewhere. His commentary on the lex Iulia et Papia not only often offers valuable contextual elements that allow the law to be reconnected to other knowledge of Antiquity, but also gives readers an unusual perspective on the relationship between jurisprudential tradition and lex. The commentary on a legal provision - which only a hasty glance might lead us to consider as an activity subordinate to political power - enables us to perceive the extent to which Paulus, in the middle of the 3rd century A.D., weighed the weight of his scholarly authority against other exponents of his discipline and, at the same time, against the principes themselves. Questo volume, il sesto della collana dedicato alla figura di Giulio Paolo – autorevole esponente, insieme con Emilio Papiniano e con Domizio Ulpiano, della scienza giuridica severiana – ricostruisce il contenuto di un'opera che avremmo torto, ponendola a confronto con i libri ad edictum, a considerare minore: il commento alla lex Iulia et Papia, un provvedimento normativo d'età augustea. L'esame dei suoi testi, trasmessici dalla compilazione giustinianea, permette di lanciare uno sguardo su metodi e tecniche del giurista che, altrove, la scrittura paolina raramente propone. Il suo commento alla lex Iulia et Papia oltre a offrire, spesso, preziosi elementi di contesto, che consentono di riconnettere il diritto ad altri saperi dell'Antichità, regala ai lettori un inconsueto punto di vista sui rapporti fra tradizione giurisprudenziale e lex. Il commento a un provvedimento normativo – che solo uno sguardo frettoloso potrebbe indurci a ritenere attività subordinata al potere politico – ci pone in grado di percepire fino a qual punto Paolo, in pieno III sec. d. C, valutasse il peso della propria autorevolezza scientifica nei confronti degli altri esponenti della sua disciplina e, al contempo, degli stessi principes.
